Canada has two systems of private law. Quebec has a civil law system, codified in the Code civil du Québec/Civil Code of Quebec. All the other provinces have common law systems, based on English law as it was at the time of reception in the province, and as it has been developed by the courts since then. Authority to alter private law by statute is vested in the provincial legislatures by s.92(13) of the Constitution Act, 1867.

The common law system includes areas of law regulating relationship among individuals. The examples of such areas include law of contracts, law of torts, property law, law of wills and estates.
