Like in all United Kingdom jurisdictions, Legislation in Wales is made by a legislature, known as the National Assembly for Wales (The UK Parliament for non-devolved matters), which would later approve such legislation.
In Wales, Primary Legislation is known as an "Assembly Measure" which is a statute similar to the "Act of Parliament" system. The legal terms used in Acts will also be used in Assembly Measures which in turn create legal provision in Wales only. The Welsh legal jusrisdiction was created in 2007 because of the new statute making powers of the National Assembly.
The Assembly's power to make such legislation comes from a Legislative Competency Order, which itself is designed by the Assembly Government and must be approved by the Assembly and two Houses of Parliament before it is approved, which then allows the Assembly to draw up a "Measure" in that area which would go through three readings.
How the process works in Wales
- First Reading - Introduction of the Assembly Measure, the title of the Assembly Measure and it's purpose, it will also receive a short debate before it is then moved off for it's second reading.
- Second Reading - This is where ammendments can be made to the Assembly Measure, which at this point is voted on and then is transfered to the next step.
- Committee Stage - An Assembly legislative committee reviews the statute (Assembly Measure) and add more ammendments or remove previous ammendments.
- Third Reading - At this point the Assembly Measure will be sent back to the Assembly chamber for more debate, scrutinisation and additional (minor) changes, it's at this point that if all members agree to pass, the legislation is sent to the Privy Council for it to be approved by the Queen.
